Terms of Sale – Somizy

1. About us

The Somizy online store is operated by SOMIZY, sole proprietorship, registered in France under number [SIRET], with its address at France. Contact: somizy.service.client@gmail.com.

These Terms of Sale apply to all orders placed on the Somizy website. By placing an order, you confirm that you are at least 18 years old and that you accept these Terms. The Terms in force on the date of your order apply.

2. Products and health notice

Somizy sells sleep-related products, including an anti-snoring mouthpiece. Each product's main features are described on its product page. Photos are as accurate as possible but may differ slightly from the actual product.

The anti-snoring mouthpiece is intended for adults 18 years and older as an aid to reduce snoring. It is not intended to diagnose or treat sleep apnea or any other medical condition. Read the instructions for use before first use. Do not use it, and consult a doctor or dentist, if you have sleep apnea, loose teeth, dental or jaw problems, or if you experience pain or discomfort. Somizy products do not replace medical advice.

3. Prices, taxes and duties

All prices are shown in US dollars (USD). Applicable sales tax, if any, is calculated and shown at checkout. Shipping costs are shown before you confirm your order.

Prices include all import duties and customs fees; you will not be charged anything on delivery.

We may change our prices at any time. The price charged is the one shown when you place your order.

4. Orders

After you place your order, you will receive an order confirmation by email. We may cancel an order in case of a pricing error, a payment issue or suspected fraud; in that case, you will be fully refunded.

5. Payment

Payment is taken at the time of your order, using the payment methods shown at checkout. Payments are processed securely by our payment provider; Somizy does not have access to your card details.

6. Shipping

We ship to addresses in the United States. Orders are usually shipped within [X] business days, and delivery typically takes [X–Y] business days after shipping. A tracking number is sent by email once your order ships.

If we cannot ship your order within the time stated, we will notify you and give you the choice to accept the delay or cancel your order for a full refund.

Please check your package on delivery and contact us at somizy.service.client@gmail.com, with photos, if an item is damaged or missing. If your tracking shows your package as delivered but you have not received it, contact us within [7] days.

7. Returns and refunds

You may request a return within 15 days of delivery, for an unused item in its original sealed packaging. For hygiene reasons, opened mouthpieces cannot be returned, unless defective or wrong. Return shipping is paid by the customer. Full details are in our Return & Refund Policy.

8. Damaged or defective items

If your item arrives damaged, defective or is not what you ordered, contact us within 15 days of delivery with a photo. We will replace it or refund you at no cost to you. This does not limit any rights you may have under the laws of your state.

9. Limitation of liability

To the extent permitted by law, Somizy is not liable for any indirect or consequential damages, or for damages resulting from use of a product that does not follow its instructions. Our total liability for any order is limited to the amount you paid for it. Some states do not allow these limitations, so they may not apply to you.

10. Privacy

We use your personal information (name, addresses, email, phone) only to process and deliver your order, provide customer service and, if you agree, send you offers. We share it only with the service providers needed to run the store (hosting, payment, fulfillment, shipping). 11. Disputes and governing law

If you have a problem with your order, please contact us first at somizy.service.client@gmail.com; we will do our best to resolve it quickly. These Terms are governed by the laws of France, without depriving you of the protection of any mandatory consumer laws of your state of residence.

12. Changes to these Terms

We may update these Terms at any time. The version in force on the date of your order applies to that order.
